This End User License Agreement (“EULA”) is an agreement between you (an individual or an organisation) and Solvix Studio (“we”, “us”, “our”), the maker of Analyzine, a WordPress plugin (“the Software”). By buying, downloading, installing or using Analyzine, you agree to this EULA. It works alongside our Terms of Service, Privacy Policy and Refund Policy.
1. Two licenses: the code and your license key
- The code. Analyzine’s code is licensed under the GNU General Public License, version 2 or later (GPL), unless a file says otherwise. The GPL gives you the right to use, study, change and share the code.
- Your license key. When you buy Analyzine, you buy a license key. The key gives you automatic updates, support and access to downloads for the number of sites in your plan, for as long as your subscription is active. This EULA is mainly about the license key.
2. Plans
- Every plan includes every feature. Plans differ only in how many sites you can activate.
- One activation = one site. You may activate your license key on as many WordPress sites as your plan allows.
- Staging, development and local copies that are not publicly accessible do not count toward your site limit.
- Need more sites? You can move to a plan with a higher site limit. Contact us and we will help you switch.
3. Subscription, renewal and expiry
- Your license is a subscription. It renews automatically at the end of each billing period (monthly or yearly) unless you cancel before the renewal date, as described in our Terms of Service.
- Payments, invoices, taxes and cancellations are handled by our Merchant of Record, Polar (Polar Software, Inc.).
- If your subscription ends, Analyzine stays installed and the data it has collected stays in your database. However, some features may stop working, and you will no longer receive updates or support until you renew.
4. Updates: check before you update
We release updates to add features, fix bugs and keep Analyzine compatible with WordPress. Every site is different, so before you install an update, we strongly recommend that you:
- Check the requirements listed for the update (WordPress and PHP versions) and make sure your site meets them.
- Read the changelog to see what has changed.
- Back up your site and database before updating.
- Test on a staging copy first, especially on stores and other sites that handle orders or bookings.
You are responsible for deciding when to install updates and for keeping backups of your site and its data.
5. Security issues and harmful activity
If we become aware of a security vulnerability in Analyzine, a cyber attack, or any other harmful activity that could affect your site or your data, we will:
- Inform affected customers as soon as we reasonably can, by email and on our website.
- Explain the risk in plain language and tell you what to do to protect your site.
- Release a fix as quickly as we can and help you apply it if you need assistance.
Security fixes are released in the latest version of Analyzine and delivered to sites with a valid license from Solvix Studio. To stay protected, keep Analyzine up to date and your license active.
If you find a security issue in Analyzine, please report it privately to [email protected] so we can fix it before it is made public, as described in our Responsible Disclosure Policy.
6. What you may not do
- Share, sell, publish or give away your license key, or use it on more sites than your plan allows.
- Use the Analyzine name or logo for a modified or redistributed copy. The GPL covers the code, not our trademarks. If you share a changed version, give it your own name.
- Expect updates or support for copies you have changed.
- Use Analyzine to collect or process visitor data in a way that breaks the law, or on sites with unlawful content.
7. Your data and your visitors’ data
- Analyzine stores the analytics it collects (visits, journeys, events and orders) in your own WordPress database, on your own server. It is not sent to us or to anyone else.
- You own your data. Your site, your content and the data Analyzine collects remain yours.
- You are responsible for your visitors’ privacy, including your privacy notice and any consent your local laws require.
- License checks and updates: to validate your license and deliver updates, Analyzine connects to solvixstudio.com and sends your license key and your site’s address. No analytics or visitor data is sent.
8. Support
Support is included while your subscription is active. It covers Analyzine itself, not third-party plugins, themes or custom code. Contact us at [email protected].
9. Refunds
We offer a 30-day money-back guarantee on your first purchase, as described in our Refund Policy. Renewal payments are not refundable. If you receive a refund, your license key is deactivated.
10. Ending this agreement
- You can stop using Analyzine at any time by uninstalling it and cancelling your subscription.
- If you seriously or repeatedly break this EULA, for example by sharing your license key, we may deactivate your license key. Your rights under the GPL are not affected.
11. Discontinuation
We may discontinue Analyzine at any time. Copies already installed remain yours under the GPL.
12. No warranty
Analyzine is provided “as is”, without any warranty, express or implied, including any warranty of fitness for a particular purpose. We work hard to make it reliable, but we cannot promise that it will be error-free or suitable for every site.
13. Your responsibility and our liability
You use Analyzine at your own risk. You are responsible for:
- deciding whether Analyzine suits your site and your needs;
- checking requirements, backing up and testing before you install or update it (see section 4);
- your site, your data, and your visitors’ privacy and consent;
- any loss that results from how you install, configure or use Analyzine.
To the fullest extent permitted by law, Solvix Studio is not liable for any damages of any kind, whether direct, indirect, incidental, special or consequential, including lost profits, revenue, data or business, arising from your use of, or inability to use, Analyzine, even if we were told such damage was possible.
If the law where you are does not allow liability to be excluded completely, our total liability is limited to the subscription fees you actually paid us for no more than three months before the claim.
This limited coverage applies only if, when the loss happened, you were using the latest released version of Analyzine with a valid, active license bought from Solvix Studio. If you were using an older version, an expired or unlicensed copy, or a copy obtained from anyone else or modified, you use it entirely at your own risk and we have no liability to you.
Indemnity: you agree to indemnify and hold Solvix Studio harmless from any claims, damages or costs (including reasonable legal fees) arising from your use of Analyzine or your breach of this EULA.
Nothing in this EULA excludes liability that cannot be excluded by law, such as liability for fraud, or removes any mandatory rights you have as a consumer.
14. Changes to this EULA
We may update this EULA from time to time. We will post the new version on this page and email active customers about significant changes. If you keep using Analyzine after a change, you accept the updated EULA.
15. Governing law
This EULA is governed by the laws of the State of Wyoming, USA, and disputes will be handled by the courts located in Wyoming. If you are a consumer, you also keep any mandatory protections of the laws where you live.
